Chuck, here's where you truly don't understand the issue, Paterno had no boss.
Paterno was the tail that wags the dog. He didn't have a boss, if you don't understand that elementary principle you are out in left field here. Paterno ran EVERYTHING that had to do with football. Period. He was Penn St. football.
Did the president fail. You bet. He allowed himself to be controlled by the god of Penn St. football called Paterno. Is Paterno legally liable? Yes. He used his clout, control, prestige, position, and any other term you want to use to absolutely dictate the failure to report.
Not to mention, if a teacher, employed by a school has knowlege of a crime against a student, reports it to the principal and the school does not report...the failure of the school to report does NOT diminish the responsibility of the teacher to report it. Look it up.
Paterno was up to his neck in it. Not only did he control the outcome, he used it as leverage to remain coaching long after he was pooping his pants.

Paterno was only suspended and fired AFTER the administration had absolutley no wiggle room left. Paterno outlasted numerous ADs and College Presidents throughout his lengthly career. It's beyond naive to believe Paterno did not have absolute control and authority over the football portion of Penn St. Bottom line, at Penn St the tail wagged the dog. It's not a hard concept to grasp. Absolute power corrupts absolutely. Jo had it, and anyone that has anything to do with Penn St. will tell you that.
Actually, if believe you are correct and that Paterno is beyond the reach of the law...that only cements the reality that the NCAA SHOULD act and bring some sense of justice to an out of control hiearchy of power within the football program.

i would have to think if any of us on this board were in the position paterno was in, reporting it to a superior, and finding nothing done about it immediately, we would have called the police ourselves. maybe sooner. if we didn't, what kind of a human being would we be? one like paterno and all the others who knew.

Joe could have done more- I've never said that he could not have.
But, the responsibility (in terms of the job) laid elsewhere. You're creating some sort of different structure because he was an important part of the university thus meaning he had greater power than even the board of trustees.
It's a nice story for a movie and allows people to fond an easy target to blame, but the president had a job and should have done it.
You've concluded that this was solely Joes fault and others that he is no better than Sandusky.
I don't agree.

You must have missed the previous post where I said the president was legally liable and wrong for allowing himself to be controlled by a coaching legend with too much power.
I also said McQueery should have stopped the crime in progress.
There is plenty of blame to go around...unlike you...I don't believe Paterno should get a pass and I certainly don't believe the program should evade NCAA sanctions.

Facts? You use that term rather loosely. This was the opinion of An individual intepreting pieces of informaton. Nothing more.
We'll find out what the president and such knew at trial- as it should be.
Until such time, I'll withhold judgment.
As for Grambling, its disgusting to see their opportunistic asses try and capitalize on this situation.
